Welcome to Restups. These Terms and Conditions govern your access to and use of the Restups website, platform, QR code menu generator, digital menu pages, and related services available through restups.com.

By accessing or using our Services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Services.

1. About Restups

Restups is a digital platform that enables restaurants, cafés, coffee shops, and similar businesses to create and manage digital menu pages and generate QR codes for customer access.

Restups does not prepare food, deliver products, or directly process restaurant orders unless explicitly stated as part of a separate service.

2. Definitions

For the purposes of these Terms:

• “Restups”, “we”, “our”, or “us” means the owner and operator of the Restups platform.
• “User”, “you”, or “your” means any individual or business using our Services.
• “Services” means the tools and features provided by Restups, including QR code generation, digital menu creation, hosted pages, content management, and related functionality.
• “Venue” means a restaurant, café, coffee shop, food truck, bakery, or similar business using the platform.

3. Eligibility

You must be at least 18 years old and legally authorized to act on behalf of your business to use the Services. If you register on behalf of a company or venue, you confirm that you have the authority to bind that entity to these Terms.

4. Scope of Services

Restups may provide the following services:

• QR code generation for menus and venue pages
• Digital menu page creation and hosting
• Category and item management
• Venue profile management
• Uploading text, images, pricing, and descriptions
• Basic branding and customization features
• Related administrative and support tools

We may add, modify, suspend, or discontinue any part of the Services at any time.

5. Account Registration and Security

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Keep your account credentials secure
• Be responsible for all activities under your account
• Notify us immediately if you suspect unauthorized access

You are responsible for maintaining the confidentiality of your login information.

6. User Content and Venue Responsibility

You are solely responsible for all content published through your account, including but not limited to:

• Venue name and contact details
• Menu items and categories
• Prices
• Product descriptions
• Images and logos
• Offers and promotions
• Allergen information
• Ingredient or nutritional information
• Opening hours and service details

You confirm that:

• The information you publish is accurate and lawful
• You own the content or have the right to use it
• Your content does not violate any third-party rights or applicable laws

Restups is not responsible for inaccuracies in your menu content, pricing, allergen disclosures, stock availability, or any business decisions made based on content you provide.

7. QR Codes and Hosted Pages

Restups generates QR codes and may host linked digital menu pages for your venue.

You understand and agree that:

• QR codes generated by the platform are intended only for lawful business use
• The linked pages and their content remain your responsibility
• Restups may remove or disable QR codes or pages that violate these Terms or applicable laws

We do not guarantee that QR codes will remain active indefinitely if your account is suspended, terminated, expired, or unpaid.

8. Acceptable Use

You agree not to use Restups to:

• Publish false, misleading, or deceptive information
• Promote unlawful, harmful, or abusive content
• Upload malicious software, scripts, or harmful code
• Attempt unauthorized access to our systems or user accounts
• Interfere with the platform’s normal operation
• Infringe copyrights, trademarks, or other rights
• Use the platform for spam, fraud, or impersonation

We reserve the right to suspend or terminate access for misuse.

9. Subscription, Fees, and Payments

Some Restups services may be offered on a paid subscription or usage-based basis.

By using paid services, you agree that:

• You will pay all applicable fees shown on the platform
• Fees may be charged monthly, yearly, or according to the selected plan
• Payments may be due in advance
• Fees are non-refundable unless otherwise stated
• Failure to pay may result in suspension, downgrade, or account termination

10. Trials and Free Plans

Restups may offer free plans, limited plans, or trial periods. These may include feature limitations such as restricted menus, page limits, QR code limits, branding restrictions, or reduced customization.

Our Services may rely on or integrate with third-party providers such as hosting providers, analytics tools, payment providers, communications tools, or media services.

We are not responsible for the performance, availability, or policies of third-party services.

12. Intellectual Property

All rights in the Restups platform, including software, interface design, branding, trademarks, and system features, belong to Restups or its licensors.

You retain ownership of the content you upload. However, you grant Restups a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and process your content solely for the purpose of operating, maintaining, and improving the Services.

You may not:

• Copy or resell the platform
• Reverse engineer the software
• Use Restups branding without permission
• Reproduce any part of the platform for commercial exploitation without authorization

13. Service Availability

We aim to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation.

Service availability may be affected by:

• Maintenance
• Software updates
• Hosting issues
• Security incidents
• Network failures
• Events beyond our reasonable control

Restups is not liable for downtime, temporary interruptions, or data access issues.

14. Data and Privacy

Your use of the Services is also subject to our Privacy Policy.

You acknowledge that we may collect and process account, business, usage, and technical data as necessary to operate the platform.

You are responsible for ensuring that any personal or customer data you upload complies with applicable privacy and data protection laws.

17. Limitation of Liability

To the maximum extent permitted by law, Restups shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, data, business opportunities, or reputation.

Our total liability arising out of or related to the Services shall not exceed the amount paid by you to Restups during the twelve (12) months preceding the event giving rise to the claim.

18. Indemnification

You agree to indemnify and hold harmless Restups, its affiliates, officers, employees, and partners from any claims, damages, liabilities, losses, or expenses arising from:

• Your use of the Services
• Your content
• Your breach of these Terms
• Your violation of any law or third-party rights
